Po folks can fight back by using the court systems properly.

On November 15, 2023 I did in fact go to court and met with the judge, defendants and attorney.

Immediately Judge Eighmy who was overseeing this matter made it clear this is not for his venue and he would not be the one entertaining this type of request.

Small Claims Court – Dismissed by the court without prejudice. I concurred and proceeded to exit the room to head down stairs to immediately pay for the higher court as all the paperwork I needed was readily available. Plus I would have been able to have them served while at court that day.

As my family and I were leaving the courtroom, the attorney representing Michelle and DaSilva Hawk LLC. stated: “We need to resolve this as I have looked over your paperwork thoroughly we need to work something out.

KEEP IN MIND SMALL CLAIMS COURT COULD NOT HEAR THE CASE

Their attorney asked me “what would it take” I stated, “$4,499.99.

He said let’s be reasonable. I then asked Garrett Hawk what are your numbers?. He stated $1,000. That was good enough for me because ultimately, I got “EVERY” penny back my husband told Michelle he wanted and a few dollars more.

See, on that very day she offered my husband those crispy $100 dollar bills, she went back to her office (at the Enclave) and while a person who have been living there a long time overheard Michelle talking shit about how she ain’t giving my husband nothing since he didn’t take that money.

WELL KARMA IS A BITCH – I DOUBLED HER $500

So here is where we stand. On November 15, 2023, I signed a document. One that suggests they are giving my family and I “FREE” money. They are doing this and they claim “NO” fault.

Now how is it possible that you claim no fault, but you admit on the check that this is for “Settlement and Refund.”

–NOW–

If you refer to the PETITION” you will notice I speak about “WRONGFUL EVICTION” DISCRIMINATION, FALSELY ADVERTISING, AS WELL AS STEALING OTHERS PROPERTY,” I even question WHAT TYPE OF LICENSE THEY HOLD FOR KINGS QUARTERS.

–AND–

Even though the judge dismissed it, they “DECIDED” it would be best to settle out of court. They did this because everything I stated in the “PETITION” is true. I have every piece of document to back up what I say.

–SO DO THEY ADMIT GUILT? – THEY SAY NO”

Because they have paid me, I believe there are many more who hold a “RESIDENTIAL” lease who were “WRONGFULLY” evicted and “SCAMMED” based on the evidence you have in front of you.

–PHASE ONE–

By them signing over this check to my husband and I, and indicating it is for “Small Claims” Case No: 2346-SC00058 only indicates to me that my information clearly shows the “WRONG” doings of Michelle and DaSilva Hawk, LLC. Therefore it was very important that “I” come out on top in this matter, as it now allows me the time needed to entertain the idea of opening the door for other “PO” folks like myself to proceed with court proceeding based on these “ILLEGAL” leases and “FALSE ADVERTISING” on the world wide web.

–PHASE TWO–

I will be looking into seeking a “CLASS ACTION” lawsuit against people who conduct business in this fashion.

Since moving from the Enclave at Michelle’s and DaSilva Hawk, LLC. request, my family and I have moved 4 times in less than 2 months and with every move we have met families who were “DISPLACED” by the “WRONGFUL” evictions set in motion by these individuals.

If you believe Enclave have abused you and your family in this manner, I suggest you contact an attorney now.

–LOOK AT THIS AT TRUE FACE VALUE–

This is how it works.

Michelle and DaSilva Hawk, LLC. would have spent “THOUSANDS” if not hundreds of thousands of dollars paying “COURT” fees and cost if they were to take everyone to court they have “Illegally” evicted over the last 7 years.

I picked those years because Michelle indicated to me that she had been running the “KINGS QUARTERS” for that long.

“CASENET” would have been overwhelmed by the mass amount of evictions coming from one entity. Also, it would be made clear the mass destruction they were doing to good “PO” families as the numbers would “NOT” lie.

–SO HOW DID THEY SOLVE THAT PROBLEM–

Michelle and DaSilva Hawk, LLC. solicits the “FREE” services the Branson Police Dept. have offered over the years. (ALTHOUGH US WORKING “PO” FOLKS PAY FOR IT IN TAXES)

They have worked solely with the mindset of “THIS IS A HOTEL” so the “OUT BY 5” rule counts.

They have defended people like Michelle and DaSilva Hawk, LLC. without “LEGAL” court documentation, and without even thinking about the pain families go through because of these bullshit rules.

This is something the Branson Police Dept. should have never injected themselves into because they should have known the impact this would have on families. “OUT BY 5”

I hope now that they see the destruction that has taken place.

The Forsyth courts have lost “HUNDREDS OF THOUSANDS DOLLARS” over the years as Enclave owners and manager were and have been successful at utilizing the  Branson Police Dept. to help hide the fact their leases states verbiage such as;

1) Residential Lease Agreement
2) Court Cost
3) Legal Fees
4) Result in Eviction
5) Additional Charges If You Are Late, etc.

I know this to be true because I showed my “RESIDENTIAL” lease to the officers. Conclusion – This is a “Hotel”

Michelle and DaSilva Hawk, LLC. knowingly and willfully falsely advertised their business that led to “MANY” “WRONGFUL” evictions.

This matter will be presented in phase “TWO” Michelle. It will be called a “CLASS ACTION” lawsuit.

Whether you believe it or not Michelle and DaSilva Hawk, LLC., “PO” folks are people too. We have housing rights as well.

–ON A BRIGHTER NOTE–

My granddaughters had a wonderful time shopping and spending our new found money. We have never had a “HOTEL” give us “FREE” money. We got more shopping today as we have a “BIRTHDAY” coming up soon.

The “BEAT” below represents what it feel like walking into any stores with money in my purse and granddaughter laughing and waving like celebrity girls.

“PO” FOLKS and this is happening in the middle of the month and the McRIB is back.
